Abstract
The following article, written in March 2005, examines the European Court of Justice's application of the European Convention on Human Rights. In this paper, the author discusses a number of improvements that could be made to the current set up of the courts, including the novel idea of a 'Pre-decision interpretation questions'system, which could facilitate the application of the ECHR by both the ECJ and the ECHR.
